1. Scope

The website viviere.vn is owned and operated by NGUYEN HUYNH LAN PHUONG COMPANY LIMITED ("VIVIÈRE", "we"). These Terms apply to all purchases made on the website. By placing an order, you confirm that you have read and agree to these Terms and to our Return & Exchange, Shipping, Payment and Privacy policies.

3. Products

VIVIÈRE provides truthful and complete product information (images, dimensions, materials, origin and price). Actual colors may differ slightly from the images depending on your display.

4. Prices

Prices are listed in Vietnamese dong (VND) and include value-added tax (VAT). Shipping is free for orders within Vietnam; international shipping fees are shown before you confirm payment. The applicable price is the price at the time of ordering, as stated in your order confirmation email.

5. Ordering and Order Confirmation

You select your products, enter your delivery details and pay online through the OnePay payment gateway. Your order is confirmed once payment is successful, and you will receive a confirmation email.

VIVIÈRE may decline or cancel an order if the product is out of stock, the listed price is clearly wrong due to a system error, the order information is inaccurate, or there are signs of fraud. In that case, VIVIÈRE will notify you and refund 100% of the amount paid within 5–7 business days.

6. Cancellation by the Customer

You may cancel your order free of charge before it is handed over to the carrier by contacting us by email or phone. VIVIÈRE will refund 100% of the amount paid. Once the order has been handed over to the carrier, returns are handled under our Return & Exchange Policy.

7. Supply Conditions and Limitations

  • Delivery area: nationwide in Vietnam and selected other countries, as set out in our Shipping Policy.
  • If a product goes out of stock after you order, VIVIÈRE will handle it under our Shipping Policy: you will be notified within 01 business day and may choose to wait for restock, switch products or receive a 100% refund.
  • If the website is interrupted due to maintenance or force majeure events, VIVIÈRE will notify you promptly and support orders in progress.

8. Payment, Shipping and Returns

These are governed by the Payment Policy, Shipping Policy and Return & Exchange Policy published on the website.

9. VIVIÈRE's Rights and Obligations

  • Provide correct and complete product, price and policy information; deliver the right products in the quality described.
  • Handle returns, exchanges, refunds and complaints under the published policies.
  • Protect customers' personal information under the Privacy Policy.
  • Decline or cancel orders in the cases set out in Section 5, with notice and a refund.
  • Update the website content and these Terms; changes apply to orders placed after they are posted.

10. Customer's Rights and Obligations

  • Provide accurate order information (full name, phone number, delivery address) and pay in full.
  • Inspect the goods on delivery and notify VIVIÈRE promptly of any discrepancy.
  • Receive complete information before purchase; return, exchange and receive refunds under the Return & Exchange Policy; file complaints and have them resolved as described on the Contact & Complaints page.
  • Request access to, correction or deletion of personal data under the Privacy Policy.

11. Shopify Platform

The website operates on the Shopify platform. All purchases on the website are transactions made directly between you and VIVIÈRE; Shopify is not the seller and is not responsible for these transactions.

12. Intellectual Property

The VIVIÈRE name and logo, images, content and designs on the website are owned by VIVIÈRE or its licensors and protected under Vietnamese law. They may not be copied or used for commercial purposes without VIVIÈRE's written consent.

13. Limitation of Liability and Force Majeure

VIVIÈRE is not liable for delays in, or failure to perform, its obligations due to force majeure events such as natural disasters, epidemics or infrastructure failures beyond its control. These Terms do not exclude any liability that cannot be excluded under consumer protection laws.

14. Complaints and Dispute Resolution

Complaints are received and resolved under the process on the Contact & Complaints page. The parties will first seek to resolve any dispute through negotiation; if no agreement is reached, the dispute will be settled by the competent authority in accordance with Vietnamese law.

15. Governing Law

These Terms are governed by the laws of Vietnam.
